These Terms of Service (“Terms”) govern your access to and use of the website at https://cipher01.com (the “Site”), operated by Cipher01 LLC(“Cipher01,” “we,” “us”). By using the Site you agree to these Terms. If you do not agree, do not use the Site.

1. Use of the Site

The Site is provided for general information about our services. You agree not to misuse the Site, attempt to gain unauthorized access, disrupt its operation, or use it in violation of applicable law.

2. No security advice by website

Content on the Site is informational and does not constitute security, legal, or compliance advice, and does not create a consulting relationship. Advice specific to your organization is provided only under a signed engagement agreement.

3. Service engagements

All services are governed by a separate written agreement between Cipher01 and the client (the “Engagement Agreement”), which sets out scope, authorization, rules of engagement, fees, timelines, and responsibilities. In the event of a conflict between these Terms and an Engagement Agreement, the Engagement Agreement controls for that engagement.

Offensive security testing is performed only against systems for which the client has provided written authorization and confirmed it has the right to authorize testing.

4. Confidentiality and sensitive data

Cipher01 handles client information — including penetration test reports, vulnerability findings, and forensic evidence — as confidential, consistent with our Privacy Policy and the applicable Engagement Agreement. Clients are responsible for distributing deliverables only to appropriate recipients and for securing deliverables once received.

5. Intellectual property

The Site and its content, excluding client-provided materials and third-party marks, are owned by Cipher01 and protected by applicable law. Deliverables produced during an engagement are licensed or assigned as set out in the Engagement Agreement. “Cipher01” and related names and logos are used by Cipher01 LLC.

6. Cyber insurance

Any assistance we provide relating to cyber insurance is advisory and facilitation support only — for example, helping you interpret coverage requirements, prepare supporting evidence, and improve relevant controls. Cipher01 is not a licensed insurance broker or producer and does not place, bind, or sell insurance.

7. Disclaimers

The Site is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure. Security testing reduces risk but cannot guarantee that a system is free of vulnerabilities or immune from compromise.

8. Limitation of liability

To the maximum extent permitted by law, Cipher01 will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the Site. Liability arising from a service engagement is governed by the limitation of liability in the applicable Engagement Agreement.

9. Indemnification

You agree to indemnify and hold harmless Cipher01 from claims arising out of your misuse of the Site or violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. The exclusive venue for disputes relating to the Site is the state or federal courts located in Wyoming, unless an Engagement Agreement specifies otherwise.

11. Changes

We may update these Terms from time to time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.
